Last Will & Testament

There are many different types of Will, from simple mirror Wills for couples with no dependants, to more complex Wills for couples with children and/or who have divorced or remarried. Special provisions may need to be put in place for families with children or those wishing to plan ahead in case a loved one requires full time care.

If you are separated, divorced or remarried, you may wish to make a Will with your cohabitant or new partner.

The Property Protection Will is designed to protect the deceased’s share of the home, whilst, giving their partner a lifetime interest in the property at the same time. This enables the surviving partner to remain in their home for the rest of their lifetime, whilst ensuring that children are not at risk of sideways disinheritance.

In the event that one or both parties require long term care as at November 2023, unless the laws are changed it is highly likely that the estate value will be consumed by residential care fees – often in excess of £50,000 per year, per person.

To protect your family against such a possibility, you will require a Property Protection Will.

Depending on the original purchase contract be it Joint Tenants or Tenants in Common, if a couple are cohabiting and one partner dies, you may find that your partner’s family own half the house.

There is a straightforward process which can prevent this from happening.

If disaster strikes and both parents are lost at the same time, a well-drafted Guardianship Will becomes paramount.

The future care of your children is a decision that should not be left to chance; if both parents die intestate, social services may take over.

A guardianship clause should be clearly documented in your Will.
